Website Privacy Statement

1. Information Collected and Stored Automatically

When you visit our website (the “Site”) to read or download information, Fillmore Capital Partners, LLC (“we,” “us,” or “Fillmore”) do not collect your name, email, mailing address or similar identifying information without your knowledge. However, for improvement of the Site and for site management purposes, we will automatically collect and maintain certain statistical information about your visit. This information includes:

  • The date and time (with time zone) of a website visit. the Internet and allows communications with other computers to send it content and other information.
  • Internet Protocol (IP) address.  A computer’s IP address establishes its location on
  • Type of Internet traffic associated with a specific IP address;
  • Type of Internet traffic associated with a specific time or event;
  • Type of technology used to access the Site (such as the type of internet browser and type of operating system);
  • Types of events;
  • The location associated with an event (such as apparent nation of origin);
  • Host names; and
  • Malicious software identification.

We use the above information to measure the number of visitors to the different sections of the Site, assess system performance and to help us make the Site more useful to our visitors.  To remediate computer security incidents, such data may be manually analyzed to allow computer security specialists to identify Internet Service Providers (ISPs) and, in extreme cases, to attempt to identify the specific computer and individual involved in an attack on the Site.

2. Information Collected for Website Improvement and Customization (Cookies)

The Site uses web measurement and customization technologies, commonly known as “cookies," "scripts" or "pixels", to collect information about users’ visits to the Site. Use of these technologies allows the Site to function better and allows us to better understand how the Site is used. Cookies are files placed on your hard drive by a website that store information regarding your use of that site, usually without your express knowledge.

The Site uses "session cookies” also known as “Tier 1 web measurement and customization technologies” and “persistent cookies” also known as “Tier 2 web measurement and customization technologies”.  These cookies do not collect personal information on users. Session cookies are stored in memory during an active browser session, and they are erased as soon as you close your browser after visiting the Site.  Persistent cookies can stay on your computer for longer periods of time unless a user deletes them.

The Site also uses third-party analytics tools (currently Google Analytics, Webflow, and others) to collect and analyze number of visits, pages opened, clicks, etc. This data helps Fillmore meet user needs, understand web traffic patterns and identify opportunities to improve the quality of the Site. Fillmore also uses the data for internal purposes and discloses it to employees and contractors who have a “need-to-know” in the performance of their duties for Fillmore.

3. Personally Identifiable Information (PII)

ersonally identifiable information (“PII”) means individually identifiable information about an individual collected through the Site or online services by us from you and maintained by us in an accessible form.  It may include identifiers (such as your name, title, company, email address, mailing address, and phone numbers) and other information that is maintained by Fillmore in combination with any of the identifiers (such as preferences and requirements.)

The Site does not collect PII about you when you visit, unless you choose to provide such information. Submitting PII through the Site is voluntary, and by doing so, you are giving Fillmore your permission to use the information for specific, stated purposes. However, not providing certain information may result in Fillmore's inability to provide you with services you desire.

If you choose to provide PII through the Site, through such methods as completing a web form, we will use that information to help provide you the information or service you have requested. The information we may receive from you varies based on what you do when visiting the Site.

When you submit information on the Site, you may receive emails from us regarding our products and/or services. From time to time, we may also send you emails to help us learn more about your preferences. In addition, we may use information about your interests and usage of the Site to help us improve our website design and your user experience.

If we do have PII about you, we will provide you with a readable copy of such PII at no charge. Factual errors in your PII, including information that is out of date, can be corrected by sending us a request that sufficiently details how your PII should be corrected. We encourage you to promptly update your PII if it changes.

4. Protecting Your PII

You can be assured that PII collected through the Site is secure and is maintained in a manner consistent with current industry standards. The importance of security for all PII is of utmost concern to us. Your PII is protected in several ways. Your PII resides on a secure server that only Fillmore staff and contractors have access to via password.  Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. Therefore, despite the security procedures we employ, you should be aware that it is impossible to guarantee the security of any information that you transmit to us via the Internet.

5. Sharing of Your PII

If you choose to provide PII, you are consenting to Fillmore’s use of that information and sharing it with Fillmore employees and contractors, and, in limited circumstances with third parties, to conduct business. Such employees and contractors are subject to confidentiality restrictions to protect your PII; provided, Fillmore cannot be responsible for any damages caused by the failure of unaffiliated third parties to honor their privacy obligations to Fillmore. Third parties may include law enforcement and other federal or state government agencies. Under certain circumstances, Fillmore may be required by law to disclose information you submit to other authorities for official purposes, for example, to respond to a subpoena.

In addition to the circumstances identified in the preceding paragraph, we may share PII with other companies, lawyers, agents, or government agencies in the following cases: (a) when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) the rights of Fillmore or to anyone that could be harmed by such activities; (b) when we believe in good faith that the law requires it; and (c) in situations involving threats to the physical safety of any person.

In the event we agree to sell, transfer or merge all or a portion of our business or assets, or in preparation for such operation under a non-disclosure agreement, we will endeavor to ensure that the transferee agrees to use the PII in a manner consistent with this privacy statement.

6. Use of Social Media

Fillmore uses social media sites as dynamic information sharing tools to engage in dialogue, share information and media, and collaborate with clients and the public. Fillmore does not control, moderate or endorse the comments or opinions provided by visitors to these sites. You should review the privacy policies of all social media and other websites before using them, and ensure that you understand how your information may be used. You should also adjust privacy settings on your account on any third-party website to match your preferences.

8. Links to Other Websites

Fillmore may provide links to other websites if we think they may be useful to our clients, other visitors or necessary for the performance of Fillmore’s services. When you follow a link to a non-Fillmore website, you will first be directed to a web page that reminds you that you are leaving <INSERT FILLMORE SITE URL> and that the website you are about to visit is not supervised or endorsed by Fillmore. These other websites are not within Fillmore's control. Fillmore does not guarantee the accuracy or completeness of any information on these sites. Be aware that the privacy protection provided to you on http://fillmorecap.com will not be available at the external link. Once you link to another website, you are subject to the policies of that website.

9. Changes to Policy

Fillmore reserves the right to change, modify, or amend this privacy statement at any time without prior notice to you. We therefore encourage you to refer to this privacy statement on an ongoing basis so that you understand its current terms. Information on material changes to this privacy statement will be posted on the Site for thirty (30) days.  If you do not accept a changed version of this privacy statement (for example, if you do not approve of a different way that we intend to use PII), you may let us know by letter or email. If you do not send us any objections, we will assume that you consent to changes in the privacy statement. Changes will not apply retroactively to PII that was collected before the changes to the privacy statement, except as may be required by law.

10. Children’s Privacy

Fillmore takes children’s privacy seriously. We never collect or maintain information at our websites from persons we know to be under age 13, and no part of our websites are designed to attract anyone under age 13. Please do not communicate with or contact us if you are under age.

11. California Consumer Privacy Policy

This Section 11 sets forth our California Privacy Policy, which supplements the information and provisions set forth elsewhere in this privacy statement, and is provided in order to comply with the requirements of the California Consumer Privacy Act of 2018 (“CCPA”), the California Privacy Rights Act of 2023 (“CPRA”), and other California-based privacy laws (together the “CA privacy laws”). All terms used in this California Privacy Policy have the same meaning as defined in the CA privacy laws.

    When we use the term "personal information" in this California Privacy Policy, we are referring to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer (i.e., a California resident) or household.

    Some of the personal information described in the “Category of Personal Information” table above also constitutes “Sensitive Personal Information” under the CA privacy laws. We use and disclose Sensitive Personal Information for business and compliance functions and for legally authorized purposes. We currently do not collect or use Sensitive Personal Information for the purpose of inferring characteristics about consumers.Categories of Sensitive Personal Information which we collect and use:

  • Data Retention Period
    Fillmore will retain records (hardcopy and electronic) that are legally required to be maintained. Generally, Fillmore will maintain these records, or cause them to be maintained, for at least the minimum period required. Records that are required to be maintained by more than one applicable law and/or under differing storage requirements will be maintained for the longest retention period and in accordance with the most restrictive storage standard.
  • Disclosure of Personal Information
    We may share personal information with third parties for a business purpose including delivering online advertisements to you on your devices and tailoring those ads to your interests. Whenever we disclose personal information to a third party, we enter into a contract that: (i)prevents or limits the ability of the third party to further share the information with other entities and requires the third party to keep the information confidential, (ii)contains all required obligations as well as appropriate data protection practices as prescribed by the CA privacy laws.

    Fillmore does not sell your personal information. As previously mentioned, in some instances Fillmore may share personal information with third parties. However, these instances are either not a “sale” of information under the CA privacy laws or qualify for an exemption to the definition of “sell” (such as providing information to a third party for a specific purpose).

In the event our practices change, we will update this California Privacy Policy and provide you with an option to limit our use and disclosure of your Sensitive Personal Information.

    The Right to Opt Out of Personal Information Sale/Sharing

    You have the right to direct us not to sell or share personal information we have collected about you to third parties now or in the future.

    When we receive a request, we will attempt to verify the requestor’s identity both as a California resident and by associating the identity with personal information previously collected. As such, the request must provide us with enough information that we can reasonably identify and verify that you are the person about whom we collected personal information. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.
    You may make requests on behalf of your minor children. You may also register another person with the California Secretary of State in order to authorize that person to act on your behalf.
    We will attempt to respond to all verifiable consumer requests within 45 days. In the event we need more time to respond to a request, the CA privacy laws allow for an additional 45 days extension. We will notify you within the first 45-day period if we will need to extend the time to respond.
